Abstract

The new “Brussels II B” regulation, which entered into force on the 1st of August 2022, is the new benchmark in matrimonial matters and matters of parental responsibility within the European Union. The changes made to this third version are remarkable, especially regarding international child abduction. The regulation of the intra-European wrongful removal or retention of a child is the new pillar of this instrument which strives for the return of the displaced child by every possible means. The recast of the regulation introduces a number of changes to improve the European situation in the area of judicial cooperation in family law matters. Formally speaking, the rights of the displaced child are accentuated and the protection of the child is amply displayed. However, in terms of substance, do the changes made to the mechanisms for returning displaced children really represent more guarantees for them? In this respect, we will attempt to compare the ambitious determination of the European legislator to take account of the rights of the child In relation to the reality of the new return mechanism set out in the Brussels II B regulation.

Marine Dubeau, Université Toulouse I Capitole

Graduate in French Law (Université Toulouse I Capitole), Spanish Law (Université de Valence) and holder of a double Masters in "International and European Law - Freedom, Security, Justice" (Université Toulouse I Capitole) and "Máster Universitario en Integración Europea" (Universidad Autónoma de Barcelona). She is currently a Ph.D. student at the Institut de Recherche en Droit Européen, International et Comparé (IRDEIC), where she is working on habitual residence in private international law.
