An implicit program in Balmes’ political thought

Abstract

Balmes is more of a secret than a forgotten author, someone who nearly hides behind his writings. This article contends the existence of both an implicit and explicit model in his legal and political thought. The first one corresponds to Balmes’ neo-scholastic and conservative aspects as a supporter of Spanish unity. But there is an underlying formulation of the nineteenth-century Catalan political pactism between Liberalism and Carlism. Political pactism is directly linked to the transformation of legal pactism. Both implicit and explicit programs coexist as a political agenda in Balmes’ thought, and are made compatible from the matrix he also constructed to combine scholastics and dialectics in the interpretation of social evolution and historical facts. The political pact is what allows avoiding violence and continuing to maintain the conditions for dialogue so that the government can govern as such. But his formula is lapidary: “Negotiate to compromise, reach as much as it can, and be resigned to its misfortune”.

Author Biography

Pompeu Casanovas, Universitat Autònoma de Barcelona

Pompeu Casanovas is Director of Advanced Research, Professor of Philosophy and Sociology of Law at the UAB Law School, and founder and head of the UAB Institute of Law and Technology (IDT-UAB). He has been principal investigator of over 50 national, European and international projects. He has published over 10 books and more than 200 scientific articles in the fields of legal philosophy, legal sociology, intellectual history and AI & Law. His recent publications concern the development of legal ontologies to implement Semantic Web technologies; models of governance to implement security and data protection within the Web; and mediation, online dispute resolution (ODR) and crowdsourcing to foster citizens’ democratic participation.
He served as general coordinator and co-director of the Catalan White Book on Mediation (2009-2011). He is general co-editor of the Law, Governance and Technology Series (LGTS) at Springer Verlag, the Journal of Open Access to Law (JOAL) at Cornell University and the Open Access Journal of Catalan Intellectual History. He belongs to the Scientific Board of Directors of the Erasmus Mundus Joint Doctorate in Law, Science and Technology (2012-2017).
Dr. Pompeu Casanovas holds a PhD in Philosophy from the UAB, and has carried out post-doctoral research as a visiting scholar at the University of Bari (and Rome, 1987), UCSD (California, 1990-91) and Stanford (California, 2000-2001). He has been a visiting scholar at the University of Bologna (CIRSFID, 2006) and the CNR (IRSIG, 2006), as well as a visiting professor at Victoria University (Melbourne, 2012-2013). Since 2014 he has held the post of adjunct professor at the Royal Melbourne Institute of Technology.
