Directive 2010/63/EU and cephalopods. A note on the Royal Decree 1386/2018
Abstract
Directive 2010/63/EU was the first legal text in which the European Union expressly recognized cephalopods’ sentience. These animals are the only invertebrate animals protected, but only on experimentation. This work analyses the importance of the Directive for these animals (basically octopuses, squids, cuttlefish and nautiloids) as well as the contrast which implies the lack of protection in terms of production for human consumption. This study has as its starting point on the recent RD 1386/2018, which complements and corrects the RD 53/2013, the legal text that transposed the Directive in Spain. Moreover, this article talks about farming fishes’ welfare and about the crustaceans’ sentience and their implications on experimentation and humane consumption.
