Condemned for the crime of animal abuse: Sentence no. 363/2013 of Magistrate Court no. 4 of Barakaldo (Biscay)

Abstract

The Sentence has found a woman guilty of animal abuse for tying her dog in a bag and throwing it down a hill and has ordered her to 8 months in prison and a special prohibition from working in any profession related with animals, as well as to pay a fee to the animal protection association who denounced the acts and to pay for the costs of the proceedings. The author of this commentary, which participated as a lawyer in this proceeding, signals the most important aspects of the case: the identifying chip as a test, the role of the private prosecutor in the determination of the imposed sentence, and the civil responsibility deriving from the crime.
