Origin and forms of regulation in the construction of American administrative law
Abstract
The origin of the regulation is analyzed from a point of view opposed to the classic normative intervention of the continental-French administrative State, that is, we refer to the original model of the United States of community-centric influence, as well as the implications that this other regulatory system will have in the rest of the world. For this, the role of social movements, at the beginning of the 20th century, in the appearance of different forms of regulation through their demands is highlighted. Likewise, regulatory systems are exposed that prioritize the mechanisms of self-regulation, disclosure and outcropping of information, evaluation, comparison, emulation, encouragement or reputation. For this reason, the notion of regulation can never be the Anglo-Saxon translation of our concept of administrative regulation, but rather a more complex, broad and dynamic instrument of intervention, as we will see below.
